3. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied and posted on our service in a way that constitutes copyright infringement, please provide our DMCA Agent with the following information:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (such as the URL).
- Your contact information including address, telephone number, and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
4. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in your district.
Upon receipt of a valid counter-notification, we will provide a copy to the original complainant. If we do not receive notice within 10-14 business days that the complainant has filed an action seeking a court order, we may reinstate the material.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.
Strike Policy:
- First strike: Warning and content removal
- Second strike: Warning and temporary upload restriction (7 days)
- Third strike: Account termination
Users may appeal strikes through our dispute resolution process. Appeals must be submitted within 14 days of receiving a strike notification.
6. Good Faith Requirement
Please be aware that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer or by us.
Before filing a DMCA notice, please consider whether the use may be protected by fair use or other legal doctrines.
7. Proactive Content Protection
TogetherWeRise employs the following proactive measures to prevent copyright infringement:
- Audio Fingerprinting: We use Chromaprint technology to identify potentially copyrighted content before it is published.
- AcoustID Integration: Uploaded tracks are checked against the AcoustID database of known recordings.
- User Attestation: Users must certify ownership or licensing rights for all uploaded content.
- Community Reporting: Users can flag potentially infringing content for review.
